Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website skipthedownpayment.ca (the "Site"), operated by Canada Mortgage Source Inc. ("we," "us," or "our"), a licensed mortgage brokerage in the Province of Alberta, Canada.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
1. Description of Service
The Site provides an online mortgage qualification calculator that produces preliminary, estimated pre-approval figures based on self-reported financial information you provide. The Site also collects contact information so a licensed mortgage specialist may follow up with you.
The estimates produced by the calculator are not pre-approvals, commitments, or guarantees of mortgage financing. A formal mortgage application, credit review, lender qualification, and supporting documentation are required before any actual mortgage approval can be issued.
2. Eligibility
To use the Site, you must:
- Be at least 18 years of age (or the age of majority in your province of residence, whichever is greater);
- Be a resident of Canada;
- Have the legal capacity to enter into a contract;
- Not be barred from receiving services under applicable law.
3. Accuracy of Information
You agree to provide accurate, current, and complete information when using the calculator and lead form. You acknowledge that the estimates produced by the Site rely entirely on the information you provide, and that inaccurate or incomplete information will produce inaccurate estimates.
You further acknowledge that the Site does not pull your credit report, verify your income, or otherwise validate the information you submit. Any verification occurs only as part of a separate, formal mortgage application process conducted by a licensed mortgage specialist after you provide additional consent.
4. No Mortgage Advice
The Site provides general information and preliminary estimates only. Nothing on the Site constitutes mortgage, financial, legal, tax, or investment advice. The Site is not a substitute for advice from a licensed mortgage broker, financial advisor, lawyer, accountant, or other qualified professional.
We strongly recommend that you consult with a qualified professional before making any decisions about a mortgage, refinancing, or other financial transaction. Mortgage qualification is highly fact-specific and depends on many factors that the calculator does not and cannot assess.
5. No Guarantee of Approval
Use of the Site does not guarantee that you will be approved for a mortgage with any lender. Lender approval is subject to credit review, income verification, property appraisal, lender underwriting policies, applicable federal and provincial regulations, and other criteria outside our control.
The mortgage rate, qualifying amount, and other figures shown on the Site are estimates only and may differ materially from the actual terms a lender offers you. Rates and program parameters change frequently and without notice.
6. Lender Logos and Third-Party References
The Site may display logos, names, and other identifying marks of lenders we work with as a licensed mortgage brokerage. These logos are the property of their respective owners and are displayed solely to identify lenders within our broker channel. The display of any lender logo does not constitute an endorsement by that lender of any specific product offered through the Site, nor does it guarantee that any particular lender will offer financing to you.
Final lender selection depends on your individual qualification, the lender's then-current product offerings, and the discretion of our licensed mortgage specialists.
7. Intellectual Property
All content on the Site — including but not limited to text, graphics, logos, calculator logic, software, design, and the underlying compilation of these elements — is the property of Canada Mortgage Source Inc. or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may view and use the Site for your personal, non-commercial use of obtaining a mortgage estimate and contacting us. You may not:
- Copy, reproduce, modify, distribute, or create derivative works from any portion of the Site;
- Reverse-engineer, decompile, or attempt to extract the source code or proprietary calculation logic of the Site;
- Use any data-mining, scraping, or automated extraction tools on the Site;
- Use the Site or its content for any commercial purpose without our prior written consent;
- Remove or alter any copyright, trademark, or other proprietary notices.
8. User Conduct
You agree not to:
- Submit false, misleading, or fraudulent information through the Site;
- Submit information on behalf of another person without their consent;
- Use the Site in any manner that could disable, overburden, damage, or impair it;
- Attempt to gain unauthorized access to any portion of the Site, related systems, or networks;
- Use the Site to violate any applicable law, regulation, or third-party rights;
- Submit any content that is unlawful, threatening, defamatory, obscene, or otherwise objectionable.
9. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the data practices described in that policy.
10. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by us, including but not limited to lender websites, social media platforms, and review services. We are not responsible for the content, privacy practices, or terms of any third-party site. Your interaction with any third-party site is solely between you and that site's operator.
11. Disclaimer of Warranties
The Site is provided "as is" and "as available," without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
We do not warrant that the Site will be error-free, that defects will be corrected, that the Site will be free of viruses or harmful components, or that the calculator results will match any actual lender offer.
12. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Canada Mortgage Source Inc., its directors, officers, employees, agents, brokers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to damages for lost profits, lost opportunity, lost data, or business interruption — arising out of or in connection with your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any direct damages arising from or related to these Terms or your use of the Site shall not exceed one hundred Canadian dollars (CAD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above limitation may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Canada Mortgage Source Inc. and its directors, officers, employees, agents, brokers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Site;
- Your violation of these Terms;
- Your violation of any rights of a third party;
- Any false or inaccurate information you provide.
14. Modifications to the Site and Terms
We reserve the right to modify, suspend, or discontinue the Site (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Site.
We may revise these Terms from time to time. The "Effective date" at the top of this page reflects the date of the most recent revision. Your continued use of the Site after we post revised Terms constitutes your acceptance of those revisions. We encourage you to review these Terms periodically.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts located in Edmonton, Alberta, Canada.
16. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Canada Mortgage Source Inc. regarding your use of the Site and supersede any prior agreements or understandings between us regarding that subject matter.
